SWAPP App Terms & Conditions
1. General Provisions
1.1 These Terms & Conditions govern the use of the application (hereinafter referred to as the “App”) that enables users (hereinafter referred to as “Users”) to exchange homes for holiday purposes.

1.2 By using the App, Users accept and agree to comply with these Terms & Conditions.

1.3 The App administrator (hereinafter referred to as the “Administrator”) is the company SWAPP, which owns the copyright to the software and is responsible for its operation.

2. Account Registration
2.1 Account registration is free and available to adults only. Identity verification is required via submission of a valid ID photo.

2.2 Users must provide accurate and up-to-date personal information.

2.3 Each User may have only one account. Sharing accounts with third parties is strictly prohibited.

3. Using the App
3.1 The App allows Users to offer properties for temporary exchange. Ownership of properties will be verified.

3.2 Each offer must include:

– an honest description of the property,

– current photos,

– available exchange dates.

3.3 Each exchange requires mutual acceptance by both parties.

3.4 It is forbidden to offer properties that are unsafe or in poor technical condition.

3.5 Users are obligated to respect others’ property during exchanges.

4. Exchange Procedure
4.1 An exchange occurs once both parties accept the proposed offer.

4.2 Users must agree on:

– the dates and duration of the stay,

– how keys will be handed over,

– house rules and use of equipment,

– cleaning responsibilities and other arrangements.

4.3 Users must adhere to the agreed terms and treat the property with care.

4.4 In case of problems, Users should communicate and find a mutual solution.

5. Payments and Deposits
5.1 Using the App requires an active subscription (minimum of 1 month).

5.2 Users may purchase exchange credits directly through the App.

5.3 Damage deposits may be agreed upon individually between parties before the exchange.

5.4 The App does not mediate financial settlements between Users.

6. User Responsibilities
6.1 Users must leave the property in the same condition as they found it (excluding normal wear and tear).

6.2 All damages must be reported immediately to the property owner and compensated accordingly.

6.3 Users must follow the law, social norms, and local housing regulations.

7. Exchange Cancellation
7.1 Exchanges may be canceled, but the other party must be informed in advance.

7.2 Cancellations made less than 5 days before the exchange may require covering costs incurred by the other party.

7.3 In the case of emergencies (e.g., illness, accidents), both parties are expected to be understanding and flexible.

8. Complaints and Administrator’s Liability
8.1 The Administrator is not responsible for content provided by Users (descriptions, photos, reviews).

8.2 Technical issues can be reported via the contact form in the App.

8.3 Complaints will be reviewed within 14 business days.

8.4 The Administrator is not liable for damages resulting from home exchanges.

9. Personal Data Protection
9.1 Personal data is processed solely for the purpose of providing App services.

9.2 The Administrator processes data in accordance with applicable laws and the Privacy Policy.

9.3 Users have the right to:

access their data,

edit it,

delete it,
in accordance with the procedures described in the Privacy Policy.

10. Final Provisions
10.1 The Administrator may modify the Terms & Conditions. New versions come into effect 14 days after publication.

10.2 In matters not covered by these Terms, Polish law shall apply.

10.3 Continued use of the App after changes means acceptance of the new Terms & Conditions.

10.4 The Terms & Conditions are available within the App and on the Administrator’s website.
